Vibe Play is a product of Bret R. Massey. The following Privacy Policy, Newsletter Policy, Video License Agreement and Toolbar Agreement are part of the Bret R. Massey. Massey Vibe Play video player, applications, products or services constitutes your acceptance of these terms and conditions and constitutes legally binding acceptance of this Agreement. You agree that if you help users under the age of 13 access the Vibe Play video player or services using your mobile phone/tablet, internet-enabled device, internet connection and/or facility (whether owned, leased or borrowed), you Will take full responsibility. shall not be liable for any consequences, and under no circumstances, including but not limited to negligence, shall Bret R. Massey, any third-party content provider or their respective agents be liable for any direct, indirect, or liable for accidental, special or consequential damages caused by the use or inability of a user under the age of 13 to use the Application, even if the party has been advised of the possibility of such damages.
Vibe Play is not responsible for links to its mobile applications and the inclusion of these links does not imply endorsement by Vibe Play of the material or content of those applications.
Bret R. Massey is not responsible for any third-party advertisements that may appear on the Vibe Play mobile application.
You here by acknowledge and agree that any third party applications or services accessible through the Video Player are provided to you by a third party provider and not by Vibe Play. You hereby acknowledge and agree that your use of any such third-party applications or services may also be subject to the terms of use, license agreement, privacy policy or other such agreement of the provider of such third-party applications or services. Licensor expressly disclaims any liability in connection with any such third-party applications or services or your use thereof.
If Vibe Play is unable to verify or is notified or reasonably suspects fraudulent, abusive or other illegal activity in connection with your account, or if you otherwise violate these Terms, Vibe Play reserves the right to suspend or terminate your account. rights or any other applicable terms and conditions of Vibe Play. If your account has been suspended or terminated, you will lose (temporarily or permanently, as the case may be) your account. Notwithstanding the foregoing, nothing in these terms shall exclude or limit Vibe Play's liability for death or personal injury caused by its negligence, or any other liability which cannot be excluded or limited under applicable law. The copyright and all other intellectual property rights in the mobile application
and in all text, artwork, graphics or images related to the application are and will remain the exclusive property of Vibe Play or its licensors (as applicable). Vibe Play's failure or delay in enforcing compliance with these Terms will not constitute a waiver of that term or any other provision of these Terms. If any provision of these Terms shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions. These terms and any disputes or claims arising out of or in connection with them (including any non-contractual claims or disputes) shall be governed by and construed in accordance with the laws of Singapore , and you and Vibe Play irrevocably submit to the non-exclusive jurisdiction of the courts of Singapore right.
If a user engages in inappropriate language or behavior determined by Vibe Play, the user may be banned from the entire mobile application, have their account suspended, or terminated. Inappropriate language and/or inappropriate behavior will not be tolerated on Vibe Play. Vibe Play is not responsible for User Content, postings, chats and/or communications. Users are responsible for their own actions.

· encourages or promotes illegal activities or discusses illegal activities with the intent to commit them;
2. post, Distribute or otherwise make available or transmit any data, text, messages, computer files or other material that infringes and/or violates any rights of a third party or any domestic or international law, rule or regulation, including but not limited to:

We reserve the right to remove any material and to turn over any material (including messages, emails, or postings) that violates these rules to law enforcement officials as we deem appropriate. We also reserve the right to comply with any order or otherwise cooperate with law enforcement officials to identify any user suspected of unlawful use of the Vibe Play mobile application or services.
This Agreement shall be governed by the laws of the Singapore without regard to its conflict of law provisions. The courts of Singapore shall have exclusive jurisdiction over all disputes relating to or arising out of the execution or performance of this Agreement, unless Vibe Play wishes to initiate legal proceedings in your jurisdiction. The parties waive any punitive damages in any judicial proceeding, arbitration or dispute resolution.
The copyright of all content in the App belongs to Vibe Play. You may not use this content for any purpose or in any way without authorization from the copyright owner.

These terms and conditions shall be construed in accordance with the laws of Singapore.
By submitting/posting any content, such as, but not limited to, auditions, messages, text, files, images, photos, videos, sounds, profiles, works of authorship or any other materials, you hereby grant Vibe Play, non-exclusive , a royalty-free, worldwide license (with the right to sublicense through unlimited levels of sublicenses) to use, copy, modify, adapt, translate, publicly perform, publicly display, store, reproduce, transmit and distribute such content through the Vibe Play service and Vibe Play video player or any other media. Use of the Mobile Application is conditioned on your agreement to the following terms.
Vibe Play grants you a limited, non-exclusive license to use the Vibe Play video player solely in accordance with this Agreement. The license fee is a flexible pricing schedule that can be imposed and changed at any time. The license fee is currently free. You agree to pay any such license fees that may be imposed in the future or to immediately delete the Mobile Application from you. Vibe Play has no obligation to provide any support. Vibe Play reserves the right to revoke this license and/or restrict the use of the mobile application on the application or its distribution at any time and for any reason. Mobile applications may not be used for pornographic, hate-related, racist applications, or applications that install adware or other types of applications that Vibe Play deems inappropriate in its sole discretion. Vibe Play may also exclude applications or companies from mobile application licenses at its sole discretion. If you are using a mobile application on an application and Vibe Play notifies you to delete the application, you agree to delete the application immediately. You may not package a mobile application with your mobile application or other third-party mobile applications, or require or encourage users to download another mobile application to access the video player. Without the express written consent of Bret R. Massey, you may not require users to call a premium number to access the application or promise them to acces Vibe Play mobile application or provide other premium services through a premium phone number. License terms are subject to change at any time and can be viewed on the video player.
The mobile application is provided as is without warranty of any kind. To the fullest extent permitted by applicable law, Vibe Play further disclaims all warranties, including, without limitation, any implied warranties of merchantability, fitness for a particular purpose, and infringement. The entire risk arising out of the use or performance of the products and documentation rests with the recipient. To the maximum extent permitted by applicable law, in no event shall Vibe Play be liable for any consequential, incidental, direct, indirect, special, punitive or other damages (including, but not limited to, loss of business profits, business losses or other damages). Interruption, loss of business information, or other pecuniary damages resulting from this Agreement or the use or inability to use the Products, even if Vibe Play has been advised of the possibility of such damages. This application and accompanying documentation are sold "as is" without warranty of performance or merchantability or any other warranty, express or implied. Because mobile applications may be placed on a variety of hardware and mobile application environments, no warranty of fitness for a particular purpose is provided. Users must bear the entire risk of using the mobile application. Any liability of the seller is limited to product replacement or refund of the purchase price.
You may not reverse engineer, decompile, disassemble or modify the Vibe Play video player in any way. Bret R. Massey shall retain ownership and all ownership rights of Vibe Play video player.
Vibe Play video player is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties.
Bret R. Massey has no obligation to provide maintenance or updates for the mobile application. However, any maintenance or updates provided by Bret R. Massey shall be protected by this Agreement.
By downloading, installing, using or uninstalling the Toolbar, or using the Video Player Toolbar Service, you hereby agree to indemnify, at your own expense, Licensor, its parent, subsidiaries and affiliates, its business partners, and third parties, defend and hold harmless. Bret R. Massey Toolbar Supplier and their respective directors, officers, employees and agents (the "Indemnified Parties") hold harmless from and against any and all losses, damages, injuries, causes of action, claims, demands and expenses , including legal fees and charges of any kind or nature arising out of, relating to or resulting from any claim against such Indemnified Party or any of them arising out of, relating to
· your breach of this EULA Expenses;
· your downloading, installation, use or uninstallation of Vibe Play or Vibe Play services, including without limitation any claim for personal injury (including death), reputational damage, invasion of privacy, or damage to tangible property or data (including property loss or loss of use of tangible property or data).
You agree that Bret R. Massey may change these terms and conditions at any time.
